Show I.M. Van Mierlo specialises in (international) dispute resolution both before the public court and in arbitration proceedings.
He also frequently acts as an arbitrator in national and international (construction and trade) arbitrations, under the auspices of the Netherlands Arbitration Institute (NAI) in Rotterdam and the International Chamber of Commerce (ICC) in Paris.
Toon is also involved in the Chipshol case against the Schiphol Airport, the Optas pension issue in the Rotterdam port and various disputes in the energy sector. In addition, he has been involved in various construction and construction disputes in the Rotterdam port area. Finally, he regularly assists medical practitioners in medical disciplinary matters before Regional Disciplinary Colleges and the Central Disciplinary College.
Toon graduated from the Catholic University (now Radboud University) in Nijmegen in 1981. He obtained his PhD there in 1988 on a dissertation entitled Fiduciary security, fistless and silent building. He was a lawyer from the beginning of 1988 until the end of 1993 in The Hague and Amsterdam respectively.
From 1 September 1993 he is Professor of Civil Law and Civil Procedure at Erasmus University in Rotterdam. Since 2002 he combines this with the legal profession.
As of 1 November 2007, he is partner with NautaDutilh in the practice group Corporate & Commercial Litigation in Rotterdam.
Show is editor of the Magazine for Private Law, Notarial Law and Registration (WPNR), chair of the Share Editor Text & Comments Civil Procedure. Member of the Asser Editorial Board and author in the Asser series (part: Security Rights).
He is also chairman of the Health Insurance Act Disputes Committee and frequently acts as a speaker in congresses on building arbitrations, public justice and other topics of civil law.
Toon has numerous (Dutch and foreign) publications in his name covering a broad field of Dutch private law. He is a member of the Dutch Association for Energy Law.
Toon is a member of the Benelux Restructuring & Insolvency Team.
Toon I.M. van Mierlo is gespecialiseerd in (internationale) geschilbeslechting zowel ten overstaan van de overheidsrechter als in arbitrale procedures.
Hij treedt bovendien veelvuldig op als arbiter in nationale en internationale (bouw- en handels-)arbitrages, onder auspiciën van onder meer het Nederlands Arbitrage Instituut (NAI) te Rotterdam en de Internationale Kamer van Koophandel (ICC) te Parijs.
Toon is naast anderen betrokken bij de Chipshol-zaak tegen de Luchthaven Schiphol, de Optas pensioenkwestie in de Rotterdamse haven en uiteenlopende geschillen in de energiesector. Daarnaast heeft hij gearbitreerd in diverse bouw- en constructiegeschillen in het Rotterdamse havengebied. Ten slotte staat hij met een zekere regelmaat medici bij in medische tuchtzaken ten overstaan van Regionale Tuchtcolleges en het Centraal Tuchtcollege.
Toon is in 1981 afgestudeerd aan de Katholieke Universiteit (thans: Radboud Universiteit) te Nijmegen. Hij promoveerde aldaar in 1988 op een proefschrift getiteld Fiduciaire zekerheid, vuistloos en stil pand. Hij was advocaat van begin 1988 tot eind 1993 in Den Haag respectievelijk Amsterdam.
Vanaf 1 september 1993 is hij hoogleraar burgerlijk recht en burgerlijk procesrecht aan de Erasmus Universiteit te Rotterdam. Sedert 2002 combineert hij dit met de advocatuur.
Per 1 november 2007 is hij partner bij NautaDutilh te Rotterdam in de praktijkgroep Corporate & Commercial Litigation.
Toon is redactielid van het Weekblad voor Privaatrecht, Notariaat en Registratie (WPNR), voorzitter van de deelredactie Tekst & Commentaar Burgerlijk Rechtsvordering. Lid van de Asser-redactieraad en auteur in de Asser-serie (deel: Zekerheidsrechten).
Hij is tevens voorzitter van de Geschillencommissie Zorgverzekeringswet en treedt veelvuldig op als spreker in congressen over bouwarbitrages, overheidsrechtspraak en andere topics van het burgerlijk recht.
Toon heeft talloze (Nederlandse en buitenlandse) publicaties op zijn naam staan die een breed terrein van het Nederlandse privaatrecht beslaan. Hij is lid van de Nederlandse Vereniging voor Energierecht.
Toon is lid van het Benelux Restructuring & Insolvency Team.
