Where a condominium dispute is dealt with depends on the type of dispute: the Condominium Act and the regulations, as well as the Courts of Justice Act, sets out the jurisdictions that apply to condominium disputes.

The ability for a condominium corporation to charge back an expense (for example, the cost of a contractor or legal fees) will depend largely on a particular condominium corporation’s declaration, by-laws and/or rules. A “chargeback” which is properly added to the common expenses can be enforced by way a condominium lien.
